四 | 谭敏涛分析，违法行为人散布地震谣言，到底是给予行政处罚还是刑事拘留，取决于是否严重扰乱社会秩序，是否造成了公共秩序紊乱。如果仅仅是散布谣言，社会公众并没有因此害怕，也没有造成社会恐慌，那么这属于行政违法行为，公安机关可以给予行政处罚。但谣言如果导致社会公众紧张，而且造成多数人逃离，这属于严重扰乱社会秩序，公安机关可以组织刑事拘留。

五 | “因此，公安机关可以根据谣言的社会危害性大小，依法给予相应的刑事处罚或行政处罚。”他称，根据《中华人民共和国防震减灾法》，只有省、自治区、直辖市人民政府可以发布本行政区内的地震预报意见。
